What is a DUI in Nevada? This is commonly known as drunk driving, but you don't need to be actually drunk. You don't need to be driving, only in actual physical control. You could be impaired. If you are over the legal Blood Alcohol (BAC) of .08, limit within 2 hours, you are considered under the influence and could be convicted of DUI.

Even if it is a more than 2 hours if you are slightly under the influence of alcohol that makes you incapable of diving safely, you could be found guilty also.

You can seal your criminal record in Nevada, but it is not as easy as it sounds. They recently changed the procedure making it more difficult. There are pitfalls for the unwary. Lots of little persnickety changes could result in your petition being kicked back. It could take an additional 6 months to complete if you are not aware of these things. Make sure you do it right! That why you need the help of an attorney. In addition to filing with the Metro Police Department (LVMPD), you must also send the court order to the Nevada Criminal Repository. Once your record is sealed it is removed from Government databases.

If your case is dismissed, you may seal it right away, but if you have a conviction it takes longer depending on what you were convicted of. Once sealed In Nevada if anyone asks have you ever been arrested or charged with a crime, you can truthfully say no. This is a legal fiction but that is the law. NO ONE will be able to find this out. So your job prospects aren't affected, I recommend that EVERYONE who qualifies, should have their record sealed.

Similar to "expungement", record sealing in Nevada hides any notice that you were arrested for or convicted of a certain crime. Once your records are sealed from view you can legally tell potential employers, landlords and others that you were never even charged with that crime.
