I have been representing Dr. Richard Teh who was unjustly accused of murder. The state alleged that a patient of Dr. Teh died due to an alleged overdose of medication prescribed by Dr. Teh, which was not true. The woman that died was a patient of Dr. Teh but she died of sepsis.
However the Clark County coroner's office originally stated that the cause of death was due to an overdose. (they were wrong!) Even though Hospital records showed that she died of pneumonia and an infection. She died because of Pseudomonas Aeruginosa, a particularly virulent bacteria. In fact some doctors call it the Black Mamba of bacteria. If you are afflicted and you do not do something to combat it very quickly (within eight hours) it is fatal.
Dr. Teh saw the decedent about 1 month earlier for pain and an infection named Thrush. (Not the evil organization in the 60's TV show I Spy) He prescribed and antibiotic and pain medication. The patient did not obtain antibiotic but did get some pain medication. If she had taken the anti-biotic, she probably would not have died.
After reviewing the blood results from the hospital and expert opinions that I provided, the coroner's office prepared an amended autopsy report (which is a miracle in itself) which stated (as my experts and I have been saying all along) that she died due to "Pseudomonas aeruginosa bateremia" So Dr. Teh was NOT the cause of death.
With this new information I moved the court to dismiss the murder case WITH prejudice .The DA, Dave Stanton, said that he had no legal or factual basis to oppose the motion. This was the perfect case. I liked the clients, I liked the facts, I liked the DA and the case was dismissed. Who says there is no justice!
