Bail vs. Bond

Many people are unaware of the differences between bail and bond. Here is some important information about both:

  • Bail — Bail is a monetary deposit used to ensure that the defendant will show up at trial. When bail is paid, the defendant is released until the date of trial. The courts consider the potential flight risk and the danger to the community when determining bail. The monetary amount of bail varies from crime to crime. After the defendant appears in court and the case has been completed, the money is returned.
  • Bond — Paying a bondsman is another way of securing release before the trial date. Typically, 15 percent of the bail is paid to the bondsman, and the bondsman posts the remaining 85 percent. However, unlike bail, the money is not returned after the defendant appears in court.

In appropriate cases, we will make a motion to exonerate the bail, so the money will be released to the person who posted it. We can also make a motion to exonerate the bond and return the money to the bondsman, as well as any collateral that has been pledged.
