Woman's recanted story frees convicted rapist after eight years

David Abernathy has spent more than eight years in prison for a rape his alleged victim- - once a terrified, abused 14 year old, now a repentant, religious 23 year old- - says never happened. He was set free Tuesday. And so, in a way, was his accuser. Abernathy, 41, was convicted in 1990 of two counts of sexual assault for the rape of Brandi Garrett. The conviction was based almost entirely on her testimony. Now Garrett says she lied. She came to Las Vegas this week expecting to have to tell that to a judge who could then grant a new trial. Instead, Abernathy pleaded guilty to lewdness, a gross misdemeanor, in return for credit for time served and instant release. He entered a type of guilty plea that required him to admit only that prosecutors could prove the case against him. Abernathy's attorney, Mace Yampolsky, said he understands why a man who has already spent nearly a decade in prison for a crime that never happened would be willing to take a deal rather than take his chances again. "It's a decision I'm glad I didn't have to make," the lawyer said.
