IF YOU PLEAD GUILTY OR ARE FOUND GUILTY, DO YOU KNOW:

1. That you will be sentenced by the Court and no one can promise or tell you what the sentence will be?

2. That for a first offense the Court may impose not less than 48 hours, but not more than 96 hours of community service or from 2 days up to six months in the Clark County Detention Center; fines and assessments from $560.00 up to $1,175.00; DUI school; and Victim Impact Panel. If your blood/breath alcohol level was 0.18% or more, the Court shall, before sentencing, require an alcohol/drug dependency evaluation and assess a $100.00 fee. The court may order a Breath Interlock Device installed on any vehicle you own or operate for not less than 3 months nor more than 6 months at your expense. Further, the Department of Motor Vehicles may revoke or suspend your driver's license for 90 days and may impose a $35.00 civil penalty.

3. If you are found guilty of a second offense within 7 years you will be jailed in the Clark County Detention Center have residential confinement for not less than 10 days nor more than 6 months; fines and assessments from $925.00 up to $1,175.00; Victim Impact Panel; and mandatory community service of not less than 100 hours nor more than 200 hours. The Court shall, before sentencing require an alcohol/drug dependency evaluation and asses a $100.00 fee, and the Court may order you into a program for treatment. The Court must order a breath interlock device installed in any vehicle you own or operate for not less than 6 months nor more than 12 months at your own expense. That the Department of Motor Vehicles may revoke or suspend your driver's license for 1 year, and may impose a $35.00 civil penalty.

4. If you are found guilty of a third offense within 7 years it is a Class B felony and you will be jailed in the Nevada State Prison for a non-probational or parolable sentence 1 year up to 6 years; fines and assessments not less than $2085.00; and the Victim Impact Panel. The Court must order a breath interlock device installed in any vehicle you own or operate for not less than 12 months nor more than 36 months upon your release from prison at your expense. Further, the Department of Motor Vehicles may revoke or suspend your driver's license for 3 years and impose a $35.00 civil penalty.

You may have your own lawyer or, if you qualify, the Court will appoint one for you. You may give up your right to have a lawyer if you so desire.
